El necesario análisis de alternativas en la Evaluación de Impacto Ambiental

RESUMEN
El presente trabajo tiene por objeto analizar las consideraciones efectuadas por el Tribunal de Justicia de la Unión Europea respecto de la interpretación, por un lado, de la Directiva 92/43/CEE, de 21 de mayo de 1992, relativa a la conservación de los hábitats naturales y de la fauna y flora silvestres y, por otro, la Directiva 2011/92/UE, relativa a la evaluación de las repercusiones de determinados proyectos públicos y privados sobre el medio ambiente; respecto de los requisitos necesarios para que un proyecto cuya ejecución afecte a espacios naturales protegidos pueda ser aprobado. En concreto, el Tribunal se pronuncia sobre las especies que necesariamente han de ser objeto de análisis por el promotor, la identificación de los posibles efectos significativos sobre las mismas, el necesario estudio comparativo de las «principales alternativas», así como la justificación de la alternativa seleccionada.
ABSTRACT
This paper tackles the considerations made by the Court of Justice of the European Union for the interpretation, on the one hand, of the Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora and, on the other hand, of the Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment. The Court analyses the requirements to approve a project whose execution affects protected natural areas. In particular, the Court gives a ruling on the species that are necessarily to be the subject of analysis by the developer, the identification of the possible significant effects on them, and the necessary comparative study of the "main alternatives" as well as the justification of the selected alternative.
