RESUMEN

La Unidad de Violencia Sobre la Mujer de la Fiscalía General del Estado analiza la importante reforma de los artículos 544 ter de la LECCrim y 94 del CC, tras su reforma por la La LO 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia, y la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica.
Ambas reformas afectan a la regulación del régimen de visitas en relación con los/as menores que conviven con las víctimas de violencia doméstica y de género en el contexto de la orden de protección y en el procedimiento de familia, y establece como criterio orientativo de actuación a los fiscales, que cuando existan hijos o hijas menores que convivan con una mujer víctima de violencia de género: “las/os Sras./es. Fiscales no interesarán el establecimiento de un régimen de visitas en la comparecencia de orden de protección al impedir este pronunciamiento la regulación actual del art. 544 ter LECrim. Si existiera un régimen de visitas vigente acordado por cualquier resolución judicial precedente, las/os Sras./es. Fiscales solicitarán su suspensión si los menores han presenciado, sufrido o convivido con la violencia y, solo excepcionalmente, podrá interesarse su mantenimiento cuando así lo aconseje el superior interés del menor evaluando la relación paternofilial.”

The Violence Against Women Unit of the State Attorney General's Office analyses the important reform of articles 544 ter of the LECCrim and 94 of the CC, following their reform by LO 8/2021, of 4 June, on the comprehensive protection of children and adolescents against violence, and Law 8/2021, of 2 June, reforming civil and procedural legislation to support people with disabilities in the exercise of their legal capacity. Both reforms affect the regulation of visiting arrangements in relation to minors who live with victims of domestic and gender-based violence in the context of the protection order and in family proceedings, and establishes as a guiding criterion for prosecutors that when there are minor children who live with a woman victim of gender-based violence: "Prosecutors will not be interested in the establishment of a visiting regime for minors who live with victims of domestic and gender-based violence in the context of the protection order and in family proceedings. Prosecutors will not be interested in the establishment of a visiting regime in the appearance for a protection order, as the current regulation of art. 544 ter LECrim prevents this pronouncement. If there is an existing visiting regime agreed by any previous judicial decision, the Public Prosecutors will request its suspension if the child is not in the custody order. Prosecutors will request its suspension if the minors have witnessed, suffered or lived with the violence and, only exceptionally, its maintenance may be requested when the best interests of the minor so advise, evaluating the paternal-filial relationship".n)
