RESUMEN
Partiendo de la distinción entre plazos sustantivos y procesales, en la presente encuesta se analiza si a los distintos plazos sustantivos de prescripción y caducidad del derecho material les puede resultar de aplicación los arts. 133.3 y 135.5 LEC posibilitando, cuando el día del vencimiento se produce un día inhábil su presentación al día siguiente hábil e incluso el día de gracia tal y como señala la norma rituaria. Este problema se agudiza desde la modificación de los preceptos que permite la presentación de escritos ante nuestros Tribunales los 365 días,las 24 horas del año.
ABSTRACT
Based on the distinction between substantive and procedural deadlines, this survey analyzes whether the different substantive deadlines of prescription and expiration of the substantive right can be applied to articles 133.3 and 135.5 LEC, making it possible, when the day of expiration occurs on a non-working day, to file on the following working day and even on the day of grace, as indicated in the law.
