RESUMEN

La creación de obras por inteligencia artificial supone una revolución para el Derecho de propiedad intelectual. Esta tecnología constituye una herramienta utilizada por el ser humano, existiendo un autor detrás de la obra generada que, aunque no intervenga de forma activa en la creación de la misma, es el causante de su propia existencia. Hay un amplio abanico de propuestas para abordar este dilema y la postura de los países al adaptar su legislación está siendo diversa. La pregunta para la que debe buscarse respuesta, más allá de si deben o no reconocerse derechos de autor sobre las obras creadas por inteligencia artificial, es a quién corresponden esos derechos.

The creation of works by artificial intelligence is a revolution for the regulation on intellectual property. This technology constitutes a tool used by a person, so there is an author behind the generated work who, although not actively involved in its creation, is the cause of its own existence. There is a wide range of proposals to address this dilemma and the position of the different countries adapting their legislation is not homogenous. The question for which an answer must be sought, beyond whether or not copyright should be recognized to works made by artificial intelligence, is who’s the owner of those rights.
