La responsabilidad civil por infidelidad y ocultación de la filiación extramatrimonial desde la perspectiva jurisprudencial

RESUMEN
El Magistrado JULIO PICATOSTE destaca que es novedoso hablar de responsabilidad civil en el ámbito del Derecho de Familia y la cuestión que, en definitiva, se plantea consiste en decidir si el art. 1.902 CC puede tener entre miembros de la familia el mismo juego, el mismo ámbito de aplicación que entre extraños. En este caso, el autor aborda la siguiente cuestión: ¿Pueden ser indemnizados los daños derivados de la infidelidad y ocultación de la filiación matrimonial?
Tras facilitarnos la visión del Tribunal Supremo sobre el tema y las sentencias contrarias que algunas Audiencias van apuntando, concluye que la simple infidelidad matrimonial no puede servir de motivo para reclamar indemnización por daño moral. Sin embargo, considera que sí debe reconocerse la posibilidad de reparación por daño moral en los casos en que, como consecuencia de la infidelidad, la mujer ha dado a luz un hijo cuya paternidad atribuye fraudulentamente al marido, que termina por descubrir la verdadera filiación de aquel que tuvo por hijo propio.
ABSTRACT
Judge Julio Picatoste highlights that it is new to talk about civil liability in the field of family law. The question that ultimately arises is whether article 1.902 CC can have the same scope of application, the same game, between family members as between strangers. In this case, the author addresses the following question: Can damages be compensated for damages arising from infidelity and concealment of marital affiliation?
After providing us with the Supreme Court's view on the subject and the contrary judgments that some Provincial Courts are pointing to, he concludes that simple marital infidelity cannot serve as grounds for claiming compensation for moral damages. However, it considers that the possibility of compensation for moral damages should be recognized in cases where, as a result of infidelity, the woman has given birth to a child whose paternity she fraudulently attributes to the husband, who ends up discovering the true filiation of the one he had as his own child.
