Lecciones de la pandemia del COVID-19 en relación con los pagos judiciales: la necesaria reforma del RD 467/06 sobre depósitos y consignaciones

RESUMEN
La paralización de la Administración de Justicia consecuencia de la declaración del Estado de Alarma para hacer frente pandemia del COVID-19, suscitó dudas en lo relativo a qué iba a suceder con las cuentas de depósitos y consignaciones judiciales. El análisis de la Instrucción 1/2020, del Secretario General de la Administración de Justicia asi como de la Circular 2/20 de 20 de abril lleva al Autor a dos reflexiones: los pagos judiciales deberían hacerse siempre por transferencia, salvo excepción justificada y, así mismo, es necesario regular con mayor precisión y detalle, incluso a nivel legal, los pagos a través de terceros autorizados.
ABSTRACT
The paralysis of the Administration of Justice as a result of the declaration of the State of Alarm to deal with the COVID-19 pandemic, raised doubts as to what was going to happen with the deposit and judicial consignment accounts. The analysis of Instruction 1/2020, of the Secretary General of the Administration of Justice, as well as of Circular 2/20 of April 20, leads the Author to two reflections: judicial payments should always be made by transfer, unless there is a justified exception, and it is also necessary to regulate with greater precision and detail, even at the legal level, payments through authorized third parties.
