La responsabilidad del notario por incumplimiento de las solemnidades del testamento abierto. Aproximación al artículo 705 del Código Civil

RESUMEN
El artículo 705 de Código Civil establece la nulidad del testamento abierto, como documento de últimas voluntades más usado en España, por no haberse observado en su autorización las solemnidades requeridas por la ley. Además, el mismo precepto hace responsable de la nulidad al Notario que tramitó el testamento, si su actividad incorrecta es debida a los siguientes elementos: malicia, negligencia, o ignorancia inexcusables. El análisis de la nulidad y la posible responsabilidad del Fedatario Público, que tendrá que sustanciarse en una acción judicial, constituye el objeto del presente estudio.
ABSTRACT
The Civil Code, 705 provision, establishes the nullity of the open will, as document of last wills most used in Spain, because the solemnities required by law have not been observed in their authorization. Besides, the same precept makes the Notary who processed the will responsible for the nullity, if his incorrect activity is due to the following items: malice, negligence, or inexcusable ignorance. The analysis of the nullity and the possible responsibility of the Public Authenticator, that will have to be substantiated in a legal action, it constitutes the object of the present study.
