El secreto de las comunicaciones y la investigación del delito, Cuando acaba el derecho y empieza la investigación

RESUMEN

El derecho al secreto de las comunicaciones, consagrado en las Constituciones de los países europeos y en los Convenios Internacionales, es abordado con frecuencia por parte de los jueces durante la investigación del delito.
Para adoptar medidas como la intervención de comunicaciones telefónicas, comunicaciones en vehículos, en calabozos, en prisiones, o para el registro de equipos informáticos, es necesario que el juez haga una ponderación entre la necesidad de interceptar la comunicación, el propósito de la misma, su idoneidad para la investigación y el derecho fundamental del acusado.
A través de este artículo pretendemos dar una visión general de la interacción de este derecho con la investigación judicial y los diferentes puntos de fricción que puedan surgir. Del mismo modo, se realiza un análisis de la jurisprudencia europea más reciente sobre el tema y una aproximación hacia los nuevos mecanismos de investigación más allá de las fronteras de cada país de la Unión Europea, a través del nuevo instrumento de cooperación criminal, la Orden Europea de Investigación.

The right to secrecy of communications, enshrined in the constitutions of the European countries and in International Conventions, is subject to multiple analysis by the judges, both when adopting an intervention of telephone communications, personal communications in vehicles and when addressing the right of arrested people and inmates to communicate with their families and lawyers.
During investigations it is necessary for the judge to do a thorough weighting between the need for the interception of communication, the purpose of it, its suitability to the investigation and the fundamental right of the defendant. In the same way, the judge must proceed to order the search of information contained in electronic devices and computers.
Through this article we intend to give a general view of the interaction of this right with the judicial investigation and the different points of friction that may arise. In the same way, an analysis is made of the most recent European jurisprudence on the subject and an approach to the new mechanisms of investigation beyond the borders of each country of the European Union, through the novel instrument of criminal cooperation, the European Investigation Order.

El derecho fundamental al secreto de las comunicaciones está reconocido en el ordenamiento jurídico español en el artículo 18.3 de la Constitución, en adelante CE Nota , artículo 7 de la Carta Europea de Derechos Humanos Nota , y 8 del Convenio Europeo de Derechos Humanos Nota .
