Acumulación de acciones contra avalista, fiador y arrendatario: situación actual

RESUMEN
Los arrendadores muchas veces exigen fianzas y avales como garantías del pago de la renta y el art. 437.4.3 de la Ley de Enjuciamiento Civil permite la acumulación de acciones frente a arrendatario y avalista o fiador pero ¿Cuáles son los requisitos de este requerimiento?¿Qué pasa cuando no es atendido por el fiador? Y finalmente como influirá la nueva redacción del art. 36.5 LAU tras el Real Decreto-Ley 7/2019, de 1 de marzo que fija límite de dos mensualidades a la hora de establecer garantías adicionales ¿se aplicará esta limitación a las tradicionales fianzas?
ABSTRACT
Landlords often require bonds and sureties as guarantees for the payment of the rent and art. 437.4.3 of the Civil Judgment Act allows the accumulation of actions against the tenant and guarantor or surety but what are the requirements of this requirement, what happens when it is not met by the guarantor? And finally, how will the new wording of art. 36.5 LAU influence after the Royal Decree-Law 7/2019, of March 1, which sets a limit of two monthly payments when establishing additional guarantees, will this limitation be applied to the traditional bonds?
