Análisis de las 5 principales acciones protectoras del dominio y la posesión

RESUMEN
El Código Civil regula el derecho de propiedad en el art. 348, en el que establece que es “el derecho de gozar y disponer de una cosa, sin más limitaciones que las establecidas en las leyes. El propietario tiene acción contra el tenedor y el poseedor de la cosa para reivindicarla".
En este post analizamos las cinco acciones principales que el ordenamiento jurídico concede al propietario o al poseedor para la protección de su derecho, detallando la finalidad y requisitos que son necesarios de cara al éxito y viabilidad de cada una de ellas.
Las acciones objeto de estudio son: la acción declarativa de dominio, la acción reivindicatoria, la de deslinde, la negatoria de servidumbre y la acción de tutela de la posesión.
ABSTRACT
The Civil Code regulates the right of ownership in Article 348, which establishes that it is "the right to enjoy and dispose of a thing, with no other limitations than those established by law. The owner has an action against the holder and the possessor of the thing to claim it". In this post we analyze the five main actions that the legal system grants to the owner or possessor for the protection of his right, detailing the purpose and requirements that are necessary for the success and viability of each one of them.
