Comisiones Parlamentarias de Investigación. La negativa a declarar como delito

RESUMEN
El control político de la acción de gobierno que la Constitución de 1978 atribuye al Parlamento (arts. 108 y 109 CE) se sirve de diversos instrumentos, entre los que se encuentra la creación de Comisiones de Investigación sobre asuntos de interés público (art. 76 CE).
El Derecho garantiza la labor de dichas Comisiones reconociéndoles el clásico power to send for papers and persons, que, respecto a la comparecencia obligatoria de autoridades, funcionarios y demás personas, protege el art. 502.1 CP.
La interpretación doctrinal y forense de este precepto ha dado lugar a dos posturas encontradas: una, considerar que el tipo solo castiga la inasistencia personal ante la Comisión Parlamentaria y, otra, con la que se alinea el presente trabajo, entender que también lo hace con quien se niega a declarar ante ella sin motivo legítimo que lo justifique.
ABSTRACT
The political control of governmental action that the 1978 Constitution attributes to Parliament (articles 108 and 109 EC) relies on various mechanisms, among which we find the creation of Investigation Committees on matters of public interest (article 76 EC).
The law guarantees the work of these Committees by giving them the classic power to send for papers and persons, which, with regard to the obligatory appearance of authorities, officials and other persons, is protected by art. 502.1 CP, which is the subject of this paper.
