Sobre las razones de la prisión permanente revisable en la Exposición de Motivos de la Ley Orgánica 1/2015, de 30 de marzo: ¿Conforme al TEDH? ¿De acuerdo con el TC? ¿Acorde a la sociedad?

RESUMEN
El presente trabajo aborda los dos principales argumentos del legislador de 2015 sobre la introducción de la prisión permanente revisable en el ordenamiento jurídico español y expresados en la Exposición de Motivos de la L.O. 1/2015, de 30 de marzo. El primero es una apelación directa a la sociedad, a la necesidad de fortalecer la confianza de la ciudadanía en la Administración de Justicia. El segundo, una justificación de la adecuación de dicha pena a los estándares mínimos exigibles de conformidad con el Tribunal Europeo de Derechos Humanos, basándose entre otras sentencias en la STEDH Hutchinson c. Reino Unido, de 3 de febrero de 2015. Frente a este nuevo giro punitivo del legislador, la doctrina penal ha manifestado su rechazo en bloque a esta pena cuestionando su legitimidad precisamente a la luz de dicha jurisprudencia del TEDH y del propio Tribunal Constitucional. De conformidad con ello, el objetivo de esta contribución es tratar de responder a las tres preguntas que surgen a partir de dicha Exposición de Motivos: la adecuación de esta pena al Convenio Europeo de Derechos Humanos, su constitucionalidad y la demanda social.
ABSTRACT
This paper addresses the two main arguments of the 2015 lawmaker on the introduction of the reviewable permanent prison in the Spanish legal system and expressed in the Explanatory Memorandum of the L.O. 1/2015, of 30 March. The first is a direct appeal to society, to the need to strengthen citizens' confidence in the administration of justice. The second is a justification of the adequacy of this punishment to the minimum standards required in accordance with the European Court of Human Rights, based among other judgments in the ECHRS Hutchinson v. United Kingdom, of 3 February 2015. Faced with this new punitive turn of the lawmaker, the scholars have expressed its rejection of this penalty, questioning its legitimacy precisely in the light of the jurisprudence of the ECtHR and the Constitutional Court itself. Accordingly, the objective of this contribution is to clarify whether such penalty is in accordance with the provisions of the ECtHR, in agreement with our Constitutional Court, and in accordance with society as argued in the Explanatory Memorandum.
