Desafíos en la nueva tipificación de la agresión sexual: sumisión química, una “Violencia 3.0” y una víctima sin memoria

RESUMEN
Las agresiones cometidas mediante sumisión química sobre la victima están adquiriendo datos alarmantes. Según los últimos datos, la sumisión está detrás del 30% de las agresiones sexuales. En el presente trabajo, trataremos de abordar los desafíos que se presentan ante la inminente próxima reforma del Código Penal. Víctimas “sin memoria”, que no pueden demostrar que realmente han sido atacadas o agredidas sexualmente, lo que no dejar de ser una nueva revictimización. El proceso de incapacidad al que se ve sometido la víctima está caracterizado por un hecho inesperado, que incluye la imposibilidad de articular palabras y la imposibilidad de recordar los hechos acontecidos. A ellos se añaden las dificultades probatorias dentro del proceso penal.
Esta última consideración, forma parte sustancial del hecho delictivo, pues la víctima sufre amnesia lo que le incapacita para recordar lo que ha sucedido durante el curso del efecto de la sustancia química, que provoca una situación de indefensión y desamparo que agudiza el problema, agravado por el hecho de que, ante la imposibilidad de recordar, tiene muchas dificultades para plantear ante la justicia los hechos de forma clara.
Por ello, realizando un estudio desde la jurisprudencia más actual y del panorama del Derecho comparado, se ofrecen algunas soluciones para la reforma del art. 181.4 CP. Los avances en esta sociedad exigen al legislador dar respuesta a los desafíos que nos propone esta nueva “violencia 3.0”, de freno imparable y con gran impacto mediático en los contextos sociales, sobre todo, en los más vulnerables, debiendo cumplir ciertos parámetros sobre la credibilidad de la víctima, la perspectiva de género y evitando la revictimización.
ABSTRACT
The aggressions committed through chemical submission to the victim are acquiring alarming data. According to the latest information, submission is behind 30% of sexual assaults. In this paper, we will try to address the challenges that arise in the face of the impending upcoming reform of the Criminal Code. Victims "without memory", who can’t prove that they have really been attacked or sexually assaulted, which is now a new revictimization. The incapacity process to which the victim is subjected is characterized by an unexpected event, which includes the impossibility of articulating words and the impossibility of remembering what occurred. To them are added the probative difficulties within the criminal process.
This last consideration is a substantial part of the criminal act, as the victim suffers from amnesia, which makes her unable to remember what has happened during the effect of the chemical sustance, which causes a situation of helplessness and helplessness that exacerbates the problem, aggravated due to the fact that, faced with the impossibility of remembering, she has many difficulties to bring the facts to justice clearly.
Therefore, conducting a study from the most current jurisprudence and the panorama of comparative law, some solutions for the reform of art. 181.4 CP are offered. Advances in this society require to the legislator respond the challenges proposed by this new “violence 3.0”, an unstoppable brake and with great media impact in social contexts, especially in the most vulnerable, and must meet certain parameters on the credibility of the victim, gender perspective and avoiding revictimization.
