Procedimiento judicial adecuado ante una subrogación en arrendamiento de vivienda sin cumplir requisitos o con plazo finalizado

RESUMEN
La subrogación en el arrendamiento de vivienda exige el cumplimiento de varios requisitos conforme el art. 16 y Disposición Transitoria Segunda, apartado 2 de la LAU 29/1994. ¿Qué sucede ante el incumplimiento de los mismos? ¿Cuál será el juicio procedente para que el arrendador recupere su propiedad? ¿En qué situación queda la persona sin derecho a permanecer en la vivienda, su calificación será de precarista?
Se trata de un tema controvertido que ha dado lugar a numerosa jurisprudencia.
ABSTRACT
The subrogation in the lease of a dwelling requires the fulfilment of several requirements in accordance with art. 16 and the Second Transitory Provision, section 2 of the LAU 29/1994.
What happens in the event of non-compliance with these requirements? What will be the appropriate legal action for the lessor to recover his property? In what situation is the person left without the right to remain in the dwelling, will he or she be classified as a squatter?
This is a controversial issue that has given rise to a great deal of case law.
