El certificado de tasación como presupuesto de la ejecución hipotecaria (art. 682.2.1º Ley de Enjuiciamiento Civil)

RESUMEN
Tras la nueva redacción del artículo 682.2.1 de la LEC dada por la Ley 19/2015, surge la duda de si es procedente o no la exigencia del certificado de tasación como requisito para acudir al procedimiento de ejecución hipotecaria, cuando el préstamo, tanto objetiva como subjetivamente, queda fuera del ámbito de aplicación de la Ley 2/1981, de 25 de marzo, de regulación del Mercado Hipotecario.
La cuestión problemática nace de la incorporación en el citado artículo de la expresión “en su caso”, y si de la misma, se debe entender que, cuando nos encontramos ante uno de los préstamos antes citados, sería posible que las partes lleguen a un acuerdo convencional de tasación o si, por el contrario, el certificado de tasación será siempre exigible, con independencia del tipo de negocio jurídico y la identidad del acreedor hipotecario.
ABSTRACT
Following the new wording of article 682.2.1 of the LEC, given by Law 19/2015, the question arises as to whether or not it is appropriate require an appraisal certificate as a requisite for resorting to the mortgage foreclosure procedure, when the loan, objectively and subjectively, falls outside the scope of application of Law 2/1981, of 25 March, about the Mortgage Market.
The problematic question emerges from the inclusion in that article of the expression "if applicable", and whether it should be understood, when we are dealing with one of the above mentioned loans, that it would be possible for the parties to reach a conventional valuation agreement or whether the valuation certificate will always be required, regardless of the type of legal transaction and the identity of the mortgagee.
