Asesoramiento jurídico a mujeres españolas víctimas de violencia de género en el extranjero

La Fundación Abogacía publica un folleto informativo para el asesoramiento de mujeres españolas víctimas de violencia de género en el extranjero.

La Fundación Abogacía Española, en colaboración con la Coordinadora de Violencia sobre la Mujer en el Exterior, del Ministerio de Asuntos Exteriores, ha publicado y distribuido un folleto informativo para el asesoramiento jurídico de mujeres españolas víctimas de violencia de género en el extranjero.

El objetivo de este díptico, distribuido entre las todas representaciones diplomáticas de España en el exterior, es contribuir al conocimiento por parte de estas mujeres víctimas de violencia de sus opciones legales en nuestro país.

Gracias al convenio suscrito por el Ministerio de Asuntos Exteriores, Unión Europea y Cooperación y la Fundación Abogacía Española el pasado mes de octubre, las mujeres españolas que están sopesando o preparando su regreso a España a causa de una situación de violencia, pueden contar con orientación jurídica al llegar a España y por vía telefónica en los días previos a su regreso.

Así, toda española que haya sido víctima de violencia según el Convenio de Estambul (haya sufrido maltrato de género, agresión o abuso sexual, acoso sexual y laboral por razón de género, matrimonio forzoso, mutilación genital femenina…) tiene la posibilidad, gratuita e inmediata, de resolver las dudas que le surjan respecto a su situación y la de sus hijas e hijos menores de edad o, en su caso, las personas españolas sujetas a su tutela, o guardia y custodia.

Hasta la fecha se han atendido nueve casos desde la firma del convenio. En todos ellos, en la Fundación se han realizado los contactos con los Colegios de Abogacía correspondientes de los lugares en la que la mujer española va a residir una vez retorne a España, para brindarle la necesaria asistencia jurídica, tanto en lo relativo a su situación como la de sus hijos menores.

Las mujeres víctimas de violencia de género y sus hijos menores de edad en el exterior se encuentran en una situación de especial vulnerabilidad. Habitualmente no cuentan con apoyo familiar en el lugar donde residen, muy a menudo dependen económicamente de su agresor o según el país donde se encuentren, los recursos de que disponen localmente para salir de la violencia no son suficientes o no responden a la totalidad de sus necesidades.

Por ello, frecuentemente la solución primera al problema es regresar a España, donde dejaron su vida anterior y donde sí cuentan con una red de apoyo. Los Consulados y Embajadas de España constituyen el primer paso de ese apoyo, al facilitarles orientación sobre los recursos formales que les asisten.

The Fundación Abogacía Española, in collaboration with the Coordinadora de Violencia sobre la Mujer en el Exterior, of the Ministry of Foreign Affairs, has published and distributed an information leaflet for the legal advice of Spanish women victims of gender violence abroad.
The aim of this leaflet, distributed to all Spanish diplomatic representations abroad, is to contribute to the knowledge of these women victims of violence of their legal options in our country.
Thanks to the agreement signed by the Ministry of Foreign Affairs, European Union and Cooperation and the Fundación Abogacía Española last October, Spanish women who are considering or preparing to return to Spain due to a situation of violence can receive legal advice on arrival in Spain and by telephone in the days prior to their return.
Thus, any Spaniard who has been a victim of violence according to the Istanbul Convention (has suffered gender-based mistreatment, sexual assault or abuse, gender-based sexual and workplace harassment, forced marriage, female genital mutilation…) has the possibility, free of charge and immediately, of resolving any doubts that may arise regarding her situation and that of her minor children or, where appropriate, the Spanish persons subject to her guardianship or guardianship and custody.
To date, nine cases have been attended to since the agreement was signed. In all of them, the Foundation has made contact with the corresponding Bar Associations in the places where the Spanish woman will reside once she returns to Spain, in order to provide her with the necessary legal assistance, both with regard to her situation and that of her minor children.
Women victims of gender-based violence and their minor children abroad are in a particularly vulnerable situation. They usually have no family support where they live, are often financially dependent on their aggressor or, depending on the country where they are, the resources available to them locally to escape the violence are not sufficient or do not meet all their needs.
For this reason, the first solution to the problem is often to return to Spain, where they left their previous life and where they do have a support network. Spanish Consulates and Embassies are the first step in this support, providing them with guidance on the formal resources available to them.
