Violencia de género: reubicación jurisprudencial del elemento machista (dominación)

RESUMEN
Desgraciadamente, las dinámicas jurídicas relacionadas con la violencia de género, y al albur de la profusa casuística fáctica, hace de aquellas un bucle de reflexión continua que incide necesariamente en la propia jurisprudencia que sobre tal fenómeno social emana.
El presente trabajo trata de aportar un elemento de reflexión más a dicha casuística, como es el de tratar de reubicar el elemento de la necesidad de una manifestación de “dominación”, hasta no hace mucho exigido jurisprudencialmente para la tipicidad penal de estos hechos, en otro contexto diferente, pues al haber desaparecido del inicial contexto, podría quizás incluirse como un aspecto más de exasperación de la pena en el propio ámbito típico del art. 153 del CP, o, extrapolándolo al ámbito de la agravante por razones de género del art. 22.4ª del CP, hacer de ese elemento “dominación” algo con sustantividad propia para ser concebido con independencia de cual sea el género del sujeto activo o pasivo.
Así, de los tres componentes (sujeto varón y víctima mujer; relación de pareja; y manifestación del hecho como supuesto dominio masculino sobre la mujer), este último, de especial trascendencia, ha desparecido de la trilogía y se hace necesario su reubicación normativa o jurisprudencial de tal manera que no desaparezca la esencia machista de los tipos penales sobre la materia.
ABSTRACT
Unfortunately, the legal dynamics related to gender violence, and at the mercy of the profuse factual casuistry, make of them a continuous loop of reflection that necessarily affects the jurisprudence itself emanated in relation to it.
The present work tries to contribute one more element of reflection to this casuistry, such as trying to relocate the element of the need for a manifestation of "domination", until not long ago legally required for the criminal nature of these facts, in another different context, since having disappeared from the initial one, it could perhaps be included as an element of exasperation of the penalty in the typical context of art. 153 CP, or, extrapolating it to the scope of aggravating by reason of gender of art. 22.4 CP, make that element "domination" something with its own substantivity to be conceived regardless of the gender of the active or passive subject.
Thus, of the three components (male aggressor and female victim; couple relationship; and manifestation of dominance over women), the latter has disappeared from the trilogy, and it is necessary to relocate it so that it does not disappear as the basis of these crimes.
