RESUMEN
La división de la cosa común, cuando resulta indivisible, plantea múltiples problemas tanto en fase declarativa como a la hora de llevar a la práctica su ejecución y subasta. En la encuesta del presente Cuaderno, ante el silencio legal, nos planteamos cual debe ser el procedimiento adecuado: ¿Debe aplicarse la normativa de la LEC, artículos 655 y ss o la normativa de la Ley de jurisdicción voluntaria sobre subastas voluntarias?. Las respuestas de los Autores ponen de manifiesto importantes matices a tener en cuenta.
ABSTRACT
The division of the common thing, when it turns out to be indivisible, raises multiple problems so much in declarative phase as at the time of carrying out its execution and auction.
