Un precepto arrinconado, el artículo 330 del Código Penal. Daños en un espacio natural protegido

RESUMEN
Hay artículos del Código Penal español cuya presencia parece meramente “simbólica” y sin aplicación práctica en la jurisprudencia; varios de ellos se encuentran en los capítulos dedicados a la protección penal del medio ambiente; y no solo algunos de aquellos tipos de reciente redacción, como el aún inaplicado art. 326 bis, introducido por LO 1/2015, sino incluso al que me refiero aquí, el art. 330, presente desde la entrada en vigor del actual Código Penal de 1995, hace pues ya más de 25 años.
Resulta difícil creer que en nuestro país no existen casos y situaciones reales de los que pudiera haberse preconizado la aplicación jurisdiccional de este precepto, y ello probablemente resida, más bien que en que nadie cometa hechos susceptibles de tal calificación, en las seculares carencias periciales de la Administración de Justicia, junto a la endeble labor inspectora de las Administraciones con competencias sustantivas y ambientales, y sin duda a la deseable mayor preparación, formación y sensibilidad de los distintos protagonistas de nuestro sistema de justicia penal.
No podemos olvidar, empero, el mandato que supone, en definitiva, el acervo comunitario en esta materia, como para empezar el Tratado de Funcionamiento de la Unión Europea (SP/LEG/7613), art. 191, o la Carta de los Derechos Fundamentales de la Unión Europea (SP/LEG/7352), art. 37, y muy en especial la Directiva 2008/99/CE, del Parlamento y el Consejo, de 19 de noviembre de 2008, sobre Protección del Medio Ambiente mediante el Derecho Penal (SP/LEG/4955).
Analizaremos el precepto.
ABSTRACT
There are articles of the Spanish Penal Code whose presence seems merely “symbolic” and without practical application in jurisprudence, several of them are found in the chapters dedicated to the penal protection of the Environment; and not only some of those types of recent writing, such as the unapplied 326 bis, introduced by LO 1/2015, but even the one to which we refer, 330, present since the entry into force of the current Criminal Code of 1995, approximately 25 years ago.
It is difficult to believe that in our country there are no real cases and situations in which the jurisdictional application of this precept could have been advocated, and this probably resides, rather than in the fact that no one commits facts susceptible of such qualification, in the ancient lack of experts of the Administration of Justice, together with the weak inspection work of the Administrations with substantive and environmental competences, and undoubtedly the desirable greater preparation, training and sensitivity of the different protagonists of our criminal justice system.
We cannot forget, however, the mandate that, ultimately, the acquis communautaire in this matter entails, such as the Treaty on the Functioning of the European Union (SP/LEG/7613), article 191, or the Charter of Fundamental Rights of the European Union (SP/LEG/7352), article 37, and especially Directive 2008/99/EC, of the Parliament and the Council, of November 19, 2008, on the protection of the environment through criminal law (SP/LEG/4955).
We will analyze the precept.
