Los tributos autonómicos que gravan la producción de energía hidroeléctrica en España y su acomodación al Derecho de la Unión Europea

RESUMEN
En España, con el objeto de corregir los efectos medioambientales negativos causados como consecuencia de la utilización de agua embalsada para la generación de energía hidroeléctrica, tanto el Estado como algunas Comunidades Autónomas han aprobado una serie de tributos que afectan a este tipo de actividad.
El régimen jurídico de estos tributos debe adecuarse y cumplir las obligaciones establecidas por el Derecho de la Unión Europea, Por ello, dicho régimen jurídico merece ser analizado para determinar dicha adecuación, teniendo presente la jurisprudencia del Tribunal de Justicia de la Unión Europea.
ABSTRACT
In Spain, in order to correct the negative environmental effects caused as a consequence of the use of dammed water for the generation of hydroelectric power, both the State and some Autonomous Communities have approved a series of taxes that affect this type of activity.
The legal regime of these taxes must be adapted and comply with the obligations established by European Union Law. Therefore, said legal regime deserves to be analyzed to determine such adequacy, bearing in mind the case law of the Court of Justice of the European Union.
