Régimen sancionador vigente en el estado de alarma

RESUMEN
La declaración del estado de alarma decretada por el gobierno para hacer frente a la pandemia ha supuesto que los españoles veamos restringido el sistema básico de libertades diseñado en la Constitución española, empezando por la libertad de circulación por el territorio nacional. No todos han cumplido dichas restricciones en los términos deseables, y así las estadísticas oficiales publicadas ponen de manifiesto que ha habido 934.785 propuestas de sanciones a ciudadanos por burlar las medidas adoptadas en el marco del estado de alarma y un total de 7.956 detenciones por ese mismo motivo. Sin embargo, el modelo sancionador empleado por las diferentes administraciones públicas no parece que sea el más adecuado en relación con las conductas que en la práctica se revelan merecedoras de un reproche social. En este estudio se pretende realizar un análisis del sistema sancionador durante el vigente estado de alarma y del encaje (o falta de él) en la Constitución y las leyes de la normativa que viene empleándose por las Fuerzas y Cuerpos de Seguridad, a instancias del Ministerio del Interior.
ABSTRACT
The declaration of the state of alarm decreed by the government to face the pandemic has meant that Spaniards see restricted the basic regime of freedoms established in the National Constitution, from the basic one of circulation through the national territory. Not everyone has complied with these restrictions in the desirable terms, and official statistics published show that there have been 934,785 proposals for sanctions against citizens for circumventing the measures adopted in the framework of the state of alarm and a total of 7,956 arrests for the same reason. However, the sanctioning model used by the different public administrations does not seem to be the most appropriate in relation to the conduct that in practice is shown to deserve social reproach. This study aims to analyse the sanctioning system during the current state of alarm and the fit (or lack thereof) in the Constitution and the laws of the regulations that have been used by the Security Forces and Corps, at the request of the Ministry of the Interior.
