La obligatoriedad de dictar el deber de recuperación de las ayudas de Estado

RESUMEN
El objeto de este trabajo es el primer motivo de casación presentado por la Scuola Elementare Maria Montessori y resuelto por la STJUE, Scuola Elementare Maria Montessori y Ferracci c. Comisión, C 622/16 P a C 624/16 P, 6 de noviembre de 2018, el cual hizo referencia a la Decisión de la Comisión Europea 2013/284/UE, de 19 de diciembre de 2012. En esencia, por lo que aquí interesa, la Comisión declaró que la exención de las entidades de la Iglesia Católica que ejercían actividades económicas de la Imposta Comunale sugli Immobili (tributo equivalente al Impuesto sobre Bienes Inmuebles español) era constitutiva de ayuda de Estado, aunque no dictó la correspondiente obligación de recuperación. Así, la Comisión alegó que era imposible obtener la información necesaria por medio de las bases de datos catastrales y fiscales italianas, lo que la mencionada STJUE ha declarado razón insuficiente para no requerir la necesaria devolución de las ayudas recibidas estableciendo jurisprudencia entorno a dicha obligación.
ABSTRACT
The purpose of this paper is to comment the first ground of appeal presented by Scuola Elementare Maria Montessori and resolved by the Judgement of the European Court of Justice of 06.11.2018, Case 622/16 P to Case 624/16 P, Scuola Elementare Maria Montessori and Ferracci v. Commission. Its object was the Commission’s Decision 2013/284 of 19th December 2012. Among other things, this Decision stated that the exemption from the Imposta Comunale sugli Immobili of the Catholic Church entities that exercised economic activities was constitutive of a State aid, but the Commission did not impose the corresponding duty of recovery of the aid declared incompatible with the European law. On this point, the Commission argued that the necessary information was impossible to obtain through the Italian cadastral and tax databases, but the European Court of Justice has considered that it was a non sufficient reason for not requiring the necessary reimbursement and has set jurisprudence about this obligation.
