El complemento de las resoluciones y la variación del fallo

RESUMEN
Siempre se habla de la intangibilidad de las resoluciones judiciales y, ciertamente, el art. 215.3 determina que, advertidas las omisiones, se procederá, en su caso, a complementar la resolución “sin modificar ni rectificar lo que hubiere acordado”, lo que podría dar a entender que el sentido del fallo nunca se puede modificar. Sin embargo, la inteligencia de tal expresión no nos puede llevar a tal conclusión, sino a entenderla en el sentido de que, con ocasión del complemento, no se pueden variar aquellos extremos sobre los que hubiera ya pronunciamiento, pero en nada afecta a las cuestiones sobre las que no se ha decidido.
ABSTRACT
There is always talk of the intangibility of judicial decisions and certainly, art. 215.3 determines that once the omissions have been noticed, the resolution will be supplemented, where appropriate, “without modifying or rectifying what has been agreed”, which could imply that the meaning of the failure can never be modified.
