Personación de las Comunidades de propietarios en los procesos civiles

RESUMEN
Aunque la comunidad de propietarios carezca de personalidad jurídica, ello no impide reconocerle capacidad para ser parte en el proceso, siendo el presidente quien la representa, si bien deberá contar con el previo acuerdo comunitario cuando se trate de accionar. En el presente comentario se cuestiona si la falta de este requisito será subsanable.
ABSTRACT
Although the community of owners lacks legal personality, this does not prevent it from being recognized as a party to the process, being the president who represents it, although it must have the prior community agreement when it is a question of taking action. This commentary questions whether the lack of this requirement can be remedied.
