La aportación extemporánea de los informes periciales: comentario a la doctrina establecida por la Audiencia Provincial de Granada

RESUMEN
La Audiencia Provincial de Granada en Pleno, pionera en esta interpretación, apuesta por el carácter extemporáneo de la aportación de informes periciales cuando la aseguradora no cumple con las obligaciones que le impone la Ley 35/2015 en sus arts. 7 y 37, esto es, cuando no aporta junto con la oferta o respuesta motivadas el preceptivo informe médico definitivo; aplica dichos artículos en relación con otros de la LEC y entiende que dicha doctrina hace precluir a la aseguradora la facultad de aportar prueba pericial al proceso.
ABSTRACT
The Provincial Court of Granada in Plenary, a pioneer in this interpretation, is committed to the extemporaneous nature of the contribution of expert reports when the insurer does not comply with the obligations that Law 35/2015 in its articles 7 and 37, that is, when the mandatory medical report is not provided together with the reasoned offer or response; applies these articles in relation to others of the LEC and understands that said doctrine makes the insurer preclude the power to provide expert evidence to the process.
