Dispensa de la obligación de declarar como testigo: la reforma introducida por la LO 8/2021, de 4 de junio, en el artículo 416 de la Ley de Enjuiciamiento Criminal

RESUMEN
Tratamiento legal y jurisprudencial actual de la dispensa de la obligación de declarar como testigos, establecida en el art. 416 de la Ley de Enjuiciamiento Criminal.
Inexistencia del derecho a acogerse a la dispensa para los cónyuges o parejas de hecho del investigado y acusado cuando la víctima ha ejercido la acción penal, e incluso cuando ha renunciado a mostrarse como acusación particular con anterioridad al plenario.
Interpretaciones diferentes sobre si a la víctima testigo que ha declarado en comisaría se le puede denegar el derecho a la dispensa a no declarar o debe prevalecer únicamente la interpretación referente a tomar solo en consideración las declaraciones de las víctimas testigo realizadas en presencia judicial.
ABSTRACT
Current legal and jurisprudential treatment of the waiver of the obligation to testify as witnesses, established in article 416 of the Ley de Enjuiciamiento Criminal.
Absence of the right to a waiver for the spouses or de facto partners of the investigated and accused when the victim has exercised the criminal action, and even when he/she has renounced to appear as a plaintiff prior to the plenary session.
Different interpretations as to whether a victim witness who has testified at the police station can be denied the right to the waiver not to testify or whether only the interpretation referring to taking into consideration only the statements of witnesses made in the presence of the court should prevail.
