Determinación de la filiación y gestación subrogada. Comentario a la Sentencia del Tribunal Supremo, Sala de lo Civil, Pleno, 277/2022, de 31 de marzo (SP/SENT/1138768)

RESUMEN
Con fecha 31 de marzo de 2022, el Pleno de la Sala de lo Civil del Tribunal Supremo se ha pronunciado sobre una filiación derivada de un contrato de gestación por sustitución (SP/SENT/1138768).
La Profesora experta en el tema, ISABEL E. LÁZARO, analiza cómo hasta ahora no han llegado al Tribunal Supremo apenas recursos que le hayan permitido pronunciarse sobre la gestación subrogada y sus consecuencias en nuestro sistema. En febrero de 2014, la Sentencia que dictó el Tribunal Supremo [TS, Sala Primera, de lo Civil, Pleno, 835/2013, de 6 de febrero de 2014 (SP/SENT/749604)] giraba en torno a la impugnación de una resolución de la Dirección General de los Registros y del Notariado que acordaba la inscripción en el Registro Civil español de la filiación de unos menores nacidos tras la celebración de un contrato de gestación por sustitución a favor de los padres intencionales, determinada por las autoridades de California con base en la legislación de dicho Estado. A las características de este caso resuelto en 2014 responden la mayoría de los que se han presentado hasta el momento.
Expone cómo la estrategia seguida por los interesados en el caso que termina con la sentencia que ahora comentamos es muy diferente. La pretensión con la que da comienzo el proceso en instancia es una demanda de declaración de paternidad con posesión de estado respecto de una mujer que había celebrado un contrato de gestación subrogada en México y se había traído de allí a un niño que era su hijo para el Derecho mexicano, pese a la inexistencia de vínculo genético ni biológico alguno con él.
Analiza en primer lugar las circunstancias de hecho, tan relevantes como se ha demostrado en la jurisprudencia del Tribunal Europeo de Derechos Humanos, para pasar a estudiar después la respuesta del Tribunal y plantearnos qué futuro cabe esperar.
ABSTRACT
On March 31, 2022, the Plenary of the Civil Chamber of the Supreme Court has ruled on a filiation derived from a surrogacy contract (SP/SENT/1138768).
The expert Professor on the subject, ISABEL E. LÁZARO analyzes how until now hardly any appeals have reached the Supreme Court that have allowed it to rule on surrogacy and its consequences in our system. In February 2014 the judgment handed down by the Supreme Court [SC, First Chamber, Civil, Plenary, 835/2013, of February 6, 2014 (SP/SENT/749604)] revolved around the challenge of a resolution of the Directorate General of Registries and Notaries that agreed the registration in the Spanish Civil Registry of the filiation of some minors born after the conclusion of a surrogacy contract in favor of the intended parents, determined by the authorities of California based on the legislation of that State . The characteristics of this case, decided in 2014, are the ones that have been presented so far.
It exposes how the strategy followed by the interested parties in the case that ends with the judgment that we now comment on is very different. The claim with which the proceedings in the first instance began is a claim for a declaration of paternity with possession of state with respect to a woman who had entered into a surrogacy contract in Mexico and had brought from there a child who was her son under Mexican law despite the non-existence of any genetic or biological link with him.
It first analyzes the factual circumstances, as relevant as they have been demonstrated in the case law of the European Court of Human Rights, and then goes on to study the Court's response and asks what future can be expected.
